Gift Willow creates its own designs: willow branches, pressed-leaf botanicals, quiet lettering for blankets, pillows, ornaments and keepsakes. We take copyright seriously, both our own and other people’s. This page explains how a copyright owner can tell us about material on giftwillow.shop that they believe infringes their work, what we do when we receive a notice, and how someone can respond if they think a notice was sent by mistake. It follows the notice-and-takedown approach of the US Digital Millennium Copyright Act (DMCA).
At a glance
- Send copyright notices to [email protected] with the subject line “Copyright notice”.
- Include the six elements listed in section 3 so we can act without delay.
- We acknowledge notices within 24 hours on business days and remove or disable access to material that infringes.
- Gift Willow is a single-brand shop: there are no third-party sellers on this site.
1. What this page covers
This page is about copyright: original works such as illustrations, photographs, written text, patterns and artwork. It applies to everything published on giftwillow.shop — product designs and images, page text, and the logo and graphics of the site. Concerns about trademarks (names, logos and brands) are handled under our Intellectual Property Policy. If you are unsure which applies, send your concern to the same email address and we will route it correctly.
2. How our designs are made
The artwork on Gift Willow products is created for Gift Willow. We do not sell products featuring cartoon characters, film or television properties, sports teams, celebrity likenesses or other people’s brands, and we do not accept personalisation text that uses them. Product images on the site show Gift Willow products. Because customers personalise items with typed text only — never with uploaded pictures — no customer artwork is printed through this site.
Even with that care, mistakes can happen: an illustration may resemble an existing work more closely than we realised, or a stock element may have been used outside its licence. If you believe that has happened with your work, we want to know.
3. How to send a copyright notice
Email [email protected] with the subject line “Copyright notice”. To be complete, your notice should include:
- A physical or electronic signature of the copyright owner or of a person authorised to act on their behalf.
- Identification of the copyrighted work you believe has been infringed — for example a link to the original artwork, a registration number, or a copy attached to the email.
- Identification of the material on giftwillow.shop that you believe infringes it, with the exact URL of each product or page, and a description of which element is concerned (for example “the willow illustration on the pillow front”).
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
Incomplete notices slow everything down. If something is missing, we reply to tell you what we need.
4. What happens after you send a notice
| Step | What we do |
|---|---|
| Acknowledgement | We confirm receipt within 24 hours on business days. |
| Review | We compare the identified material with the work described in your notice. |
| Action | Where material infringes, we remove it or disable access to it, and stop producing items that use it. |
| Follow-up | We tell you what we have done. If a counter-notice is received, we let you know as described in section 5. |
Where a design is removed, any open orders for that design are cancelled and refunded in full, and the customers affected are told that the design is no longer available. We do not share your personal details with those customers.
5. Counter-notices
Because Gift Willow publishes only its own designs, counter-notices on this site would come from Gift Willow itself or from the creator who made the design for us. If we believe a design was removed by mistake or misidentification, we may send a counter-notice to the person who sent the original notice, including:
- our signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that we have a good-faith belief the material was removed by mistake or misidentification;
- our name, address and contact details, and consent to the jurisdiction of the appropriate court.
If the original sender does not inform us within the period the DMCA provides that they have filed a court action, we may restore the material.
6. Notices that are not accurate
Please send notices only for your own work or for work you are authorised to represent. Under the DMCA, knowingly misrepresenting that material infringes, or that it was removed by mistake, can make the sender liable for damages. If you are not sure whether something infringes, you are welcome to email us with a question first; that is often the quickest route.
7. Repeat problems
We take steps to make sure that a design removed after a valid notice does not return to the site in a different product. If a design source we used turns out to be unreliable more than once, we stop using that source.
8. Other kinds of concerns
- Trademarks and brand names: see our Intellectual Property Policy.
- Personal information: if you believe your personal information appears on the site, see our Privacy Policy and email us.
- Problems with an order: use Contact Us or Submit a Ticket.
9. What is, and is not, a copyright issue
| Concern | Copyright? | Where to send it |
|---|---|---|
| An illustration on one of our blankets copies your artwork | Yes | This page — “Copyright notice” |
| A product photo on our site is your photograph | Yes | This page — “Copyright notice” |
| Our page text copies text from your website | Yes | This page — “Copyright notice” |
| A product name resembles your brand name | No, a trademark concern | Intellectual Property Policy |
| Someone is selling our designs on another site | Our copyright | Email us — we want to know |
| A general idea, such as “a blanket with grandchildren’s names” | No — ideas are not protected by copyright | No notice needed |
10. Finding the exact address of a product
A notice is most useful when it points to the exact page. Open the product on giftwillow.shop, copy the full address from your browser’s address bar (it begins with https://giftwillow.shop/products/), and paste it into your email. If the same design appears on several products — for example a pillow and a blanket — list each address. A screenshot with the element circled helps us see immediately what you mean.
11. Rights holders outside the United States
We sell to customers in the United States, Canada, Australia and New Zealand. If you are a rights holder in Canada, Australia, New Zealand or elsewhere, you are welcome to use the same process. Tell us which law you rely on if it matters to your notice; we respond to every complete notice in the same careful way, whatever country it comes from.
12. Our own work
Gift Willow’s designs, illustrations, product images and texts are protected by copyright too. If you see them used without permission — on another shop, a marketplace listing or a print-on-demand site — please send us the link. It helps us protect the designs our customers chose for their families.
13. Common subjects and original expression
Many of our designs use subjects that belong to everyone: willow trees, leaves, nests, porch swings, armchairs, family trees, short phrases such as “home sweet home”. Copyright protects a particular drawing or photograph of a subject, not the subject itself. Two artists can each draw a willow tree; what matters is whether one copied the other’s specific expression. When we review a notice, that is the question we ask, and we explain our reasoning in our reply.
14. How we keep records of notices
We keep each notice, our reply and the action taken for as long as needed to handle the matter and any follow-up, and to show that we acted properly. We use the contact details in a notice only to deal with that notice. If the law requires us to share a notice — for example with a court — we do so; otherwise we do not publish notices or share them with customers.
15. Please include in the same email
- the subject line “Copyright notice”;
- the six elements listed in section 3;
- every URL concerned, one per line;
- any reference number you use for the matter, so we can quote it in our reply.
16. For customers: personalisation text and copyright
Customers sometimes ask whether they can add a song lyric, a poem or a line from a film to a blanket or pillow. Short family phrases, names, dates and original messages are welcome. Longer quotations from songs, books, films or poems may be protected by copyright, and character names or catchphrases may be protected as trademarks. We do not produce text that uses other people’s protected material. If an order contains such text, we contact you to choose different wording, or cancel with a full refund if you prefer. Our product pages explain each field and its character limit so that the text stays short and personal.
17. A note for families
If you are a customer and an order was paused because of personalisation text, this is not an accusation of anything. We simply cannot produce other people’s protected names, characters or lyrics, and we would rather find wording with you than cancel. Most families choose a short phrase of their own in a few minutes.
If you are unsure whether a phrase you want is a problem, ask us before ordering. We answer within 24 hours on business days and will happily suggest an alternative that says the same thing in your own words.
